JLM Couture Says Hayley Paige Gutman Is In Civil Contempt on the Gram From Beverly Hills

SDNY COURTHOUSE, August 5 – In the case by JLM Couture against its former designer Hayley Paige Gutman, a dispute has arisen not only over the Instagram accounts but also comments posted on it, since taken down.

 Now on August 5, 2021, JLM Couture has moved for civil contempt against Hayley Paige Gutman, saying she violated court orders with Instagram post from Beverly Hills, Lake Tahoe, Palm Beach and St. Barts. They have also submitted videos, but these are not in PACER. Watch this site.

 On January 6, U.S. District Court for the Southern District of New York Magistrate Judge Sarah L. Cave held a proceeding. Inner City Press covered and live tweeted it, here and below.

 On January 11, it continued, another telephone conference at 4 pm in which Judge Cave expressed frustration with some waste of time. There was discussion of who would have to sign the protective order, and now to sample comments after Ms. Gutman uploaded a video and tried to make it go viral. Ms. Gutman's lawyer wants access to now taken down Instagram accounts supporting her. JLM's says she manipulated the public's view.

Judge Cave asks, Why doesn't Ms. Gutman just ask her followers to send her their comments that have now been taken down? [Seems JLM posted on "her" account and then took down the comments. The question here is, whose account was this? JLM wants protective order]

 JLM's lawyer Sarah Matz said she doesn't know if her client can now see the comments it took down. "The comments were normal...it's a very nice dress, actually. The morning after the TRO Ms Gutman posted that my client was bullying her. Then the negative backlash"

JLM's Matz: "I agree that the IG data will be relevant, later in the case, not for the P.I. [preliminary injunction.] But Ms. Gutman told people it's her account, of course they repeated it. She called my client a disgusting company

JPM's Matz: Miss Haley Paige is my client's trademark. But Ms. Gutman was using it to sell avocado oil. And salad dressing.

As to another account, Matz says carefully, It's not my understanding that JLM has any control over that account. Ms. Gutman's lawyer: What about JPM's P.R. firm?

 Silence.

Then: Matz: My client is a corporation.

On January 29, Magistrate Judge Cave held another proceeding. JLM Couture is seeking in discovery documents about Gutman promoting other businesses, zeroing in mostly on Optimum Whey and attaching social media posts. Judge Cave ordered Gutman to ask Optimum for her agreement or communications with them.
