SDNY COURT EXCLUSIVE, July 7 – Jorge Arias was indicted and detained in 2014 in a drugs and guns case.
He had been out on supervised release, when in 2020 while on drugs he broke a neighbor's Christmas lights with a pool cue and "the homeowner's two year old son suffered a laceration to his scalp."
On July 7, 2023, Arias was before U.S. District Court for the Southern District of New York Magistrate Judge Jennifer E. Lewis. Inner City Press was there, the only media in the Mag Court.
Arias had left the halfway house / Residential Re-entry Center where he was supposed to stay. He ended up in a mental hospital, from which he was out and now the SDNY prosecutors sought to detain him pending a July 12 appearance before the District (Chief) Judge.
Magistrate Judge Willis, noting that he would not be able to get his mental medications in the MDC jail but saying that while the Bail Reform Act should consider that but does, ordered Arias released because his mother and brother would ensure he appear on July 12, or lose the $25,000 bond.
The prosecutor asked for a stay to appeal to the Chief Judge. Magistrate Judge Willis said softly, "Granted."
