SDNY COURTHOUSE, July 15 – Edwin Rodriguez was arrested at 21 on gun charges and jailed. Now on Supervised Release he has been re-sentenced twice, the second time on July 15 by U.S. District Court for the Southern District of New York Judge Paul A. Engelmayer. Inner City Press covered it.
Federal Defender Julia Gatto argued that what Rodriguez needs is drug treatment. Judge Engelmayer largely agreed, but quoted what he had told Rodriguez on his last violation of supervised release: that he would be jailed.
He already has been, for six weeks amid the Coronavirus pandemic. Judge Engelmayer said if not for that, he would likely have imposed six months. As it was, he sentenced Rodriguez to three months, minus what he has already served.
During the proceeding, the court reporter politely asked for a break to urge a trespasser to leave her property. Judge Engelmayer asked, This is in New Jersey? It's outside my writ. (He sounded like he was joking).
