NYC Subway Death Told By Teenage Student As Prosecutor Names Neely But Not Penny

NYS COURTHOUSE, Nov 4 –  Opening arguments in the New York v. Daniel Penny trial took place on November 1, and Inner City Press was there. From the thread

[Through the windows, chants from down on Centre Street]   Judge: There was a witness named Ms. Rosario at 2:38 pm, I can see most of it coming in except the last part where she was asked by the officer, Did it look like he was on drugs - I don't think that will come in

On November 4, witness Yvette Rosado took the stand. The prosecutor asked her about Jordan but would not use a name, but only description, for Penny - from the thread

Rosario: I did have a video. ADA: Where were you standing? Rosario: Outside the car. ADA: Did the white man's arm ever leave Mr. Neely's neck? Rosario: Not that I saw. The police told us to go. Me and my friend we took the D train. Jordan was not moving...

Penny's lawyer: In the same way, you learned their names after? Rosario: The Marine, that's what I knew. Penny's lawyer: The prosecutor kept calling him "The White Man." I'm going to call him Danny, is that OK? Rosario: OK.
