FEDERAL COURT, Jan 21 – Hunter Allen Ehmke, charged with breaking a US Capitol window worth more than $1000 and obstruction of an official proceeding received more strenuous condition of release than other Capitol invasion defendants on January 21, including GPS monitoring and restriction to the Central District of California.
U.S. District Court for the District of Columbia Magistrate Judge G. Michael Harvey held the proceeding. Inner City Press live tweeted it, here:
AUSA requests conditions for Ehmke - "no firearms at all, & GPS monitoring," which other Jan 6 defendants today in DDC have not gotten.
Pre-Trial: With GPS he'll have to get approval to leave the Central District of California, not just the state. Judge Harvey: Any problem with getting courtesy supervision? Pre-Trial: No. What about any passport?
Ehmke: My passport was seized, by FBI I believe.
Ehmke's lawyer: We don't believe electronic monitoring is needed. He's charged with a felony, but only because of the dollar value of the window. So we want the standard conditions. AUSA: We vehemently disagree. There's video of him kicking out a Capitol window
Judge Harvey: I think he faces two felonies.
AUSA: Only one is a crime of violence. Section 1316, property over $1000, 10 years in jail.
Lawyer: What about slanderous threats to Federal judges? 18 USC 1521(c)(2)
Judge Harvey: I think it's 1512(c)(2)
Judge Harvey: It's obstruction of an official proceeding. It's a twenty year felony. I agree with the government that heightened supervision is warranted in this case. I require he stay away from DC... No firearms... GPS location monitoring as he is right now.
Judge Harvey: Next date on Mr. Ehmke is February 4, Speedy Trial Act time is excluded. Parties are excused.
