SDNY COURTHOUSE, June 30 – Uber has been sued for unlawfully using criminal history to discriminate against its drivers in NYC, including by race.
On June 30, U.S. District Court for the Southern District of New York Judge Lewis J. Liman held a proceeding. Inner City Press covered it.
The complaint describes Uber using Checkr to dig up a Virginia ticket that was characterized as a misdemeanor - leading to Mr. Golightly being deactivated from the platform without any notice or due process.
Uber is arguing that the drivers are bound by agreements to arbitrate, and to not be in class actions.
Judge Liman split the baby, as he put it, allowing for now limited to discovery to go forward while the motion to compel arbitration is considered. There are motions due on July 19, with a reply August 4.
