Taiwan Ex-Im Bank Pursues 1991 DR Congo Loan But No Progress So End of Sanctions Mulled

SDNY COURTHOUSE, Jan 5 – Taiwan or the Republic of China lent Zaire now the DR Congo $20 million in 1991. Now DRC is not paying, and Taiwan has sued. 

  Taiwan's Ex-Im Bank on December 29 filed to U.S. District Court for the Southern District of New York Judge Jesse M. Furman a status report; Inner City Press found it in the docket.  

 Taiwan's Ex-Im Bank's counsel says they met with DRC Minister of Justice Rose Mutombo - but that nothing has happened since, according to Benita Kindongo.

On January 5 Judge Furman held a conference and Inner City Press covered it. Counsel for Taiwan mentioned maybe getting the U.S. State Department involved, and noted that he had succeeded in getting Niger to pay back (some of) its loan to Taiwan, albeit after 15 years of effort.

 Judge Furman said sanctions are not meant to be punitive and might not be having an impact here. He directed Taiwan's Ex-Im Bank's counsel to address the issue in his next status letter as well as to meet and confer with Ivanhoe Mines US LLC to narrow or withdraw his subpoena as moot.

The case is The Export-Import Bank of the Republic of China v. Democratic Republic of the Congo, 16-cv-4480 (Furman)
