Bureau of Prisons Rejected Order for Diabetic Meal in MDC & Blamed Inmate Now ICE Qs

SDNY COURTHOUSE, Jan 10 – Pablo Palos Garcia is detained on drug charges in the Metropolitan Detention Center in Brooklyn.      

   On January 5, U.S. District Court for the Southern District of New York Judge John G. Koeltl held a proceeding. Inner City Press covered it. 

 Judge Koeltl had ordered the MDC to provide Garcia with meals for diabetics. But MDC counsel Sophia Papapetru responded that "there is no special diet for inmates that have diabetes... It is the inmates [sic] responsibility to refrain from poor lifestyle choices of purchases on commissary." 

 Judge Koeltl expressed surprise at the answer, and asked that the Warden respond by January 7.

 MDC Warden F. Martinez, Jr. on January 7 put in a copy of the MDC menu, and withheld exhibits about Palos-Garcia's Pill Line Med Rec and Clinical encounter.

On January 10 Judge Koeltl held another proceeding, and Inner City Press again covered it. There was talk of transfer to Hudson from MDC, or release. But would ICE then deport Palos-Garcia? The AUSA said there could be no assurances, but probably not. Judge Koeltl expressed a willingness to consider on the case, this week.
