SDNY COURTHOUSE, May 23 – A man named Brendan Dowling was presented on May 23 before U.S. District Court for the Southern District of New York Magistrate Judge Barbara C. Moses, on a warrant issued from his assault case in DC Superior Court. Inner City Press was there.
Judge Moses asked, Isn't assault a misdemeanor in the District of Columbia? The SDNY Assistant US Attorney said yes - but that it involved hitting a commuter on the head for no reason.
Brenden Dowling had just been released from New York prison, for a similar attack, the AUSA said.
The Federal Defender, who repeatedly referred to Brendan Dowling as "they," successfully argued for his release. She said they will go to a shelter but only briefly, as they are eligible for housing for people with HIV.
The case is US v. Dowling, 23-mj-4227 (Moses)
