Credit Suisse Fired Secretary After Foot Surgery Now Says Her Email Is Fraudulent so Hearing

SDNY COURTHOUSE, Aug 31 – Myra Brevard worked at Credit Suisse, before its flame-out and acquisition by UBS. When she went on disability after a foot surgery, she was terminated. She sued. 

 On August 31, 2023 U.S. District Court for the Southern District of New York Judge Lewis J. Liman held a proceeding. Inner City Press covered it. Thread:

OK - now Credit Suisse (UBS) being sued by ex-employee Myra Brevard, who worked for them years then terminated while on disability leave. CS wants to force it to arbitration, & threatens sanctions for email it says is "not authentic."

Judge: let's have a hearing  Judge: If it turns out these emails are inauthentic, there could be very serious consequences for you... I suggest you consult with counsel 

Credit Suisse lawyer: We would *hate* to have to move for sanctions...

Plaintiff: I want the hearing. 

Deputy: October 12, 9:30 am.   Judge: You'll need to testify under oath, Ms. Brevard. And I'll need to hear from the person who purportedly sent the emails  

Credit Suisse lawyer: That person, Ms. Chung, works in DC. She does have another job. Could she testify virtually?

Judge: It may be hard to assess credibility that way... 

[in the email, Chung wrote "if you signed the form in 2004 and was a rehire." Was..  

Brevard: I don't have that laptop anymore. I've been using public emails, Yahoo! and gmail.

 Judge: I may ask what happened to that laptop and when...
