SDNY COURTHOUSE, Sept 15 – The media, they say, is supposed to expose lies and bring accountability. Wasn't a reporter in Las Vegas recently killed and the local official he'd exposed accused of the murder?
But the testimony in the Trevor Milton trial, of his interviews about the Nikola Badger pick-up truck as it already existed when it was only a sketch, which Trevor took from a young designer then tweeted at Elon Musk, made the media look bad.
Milton has bragged to the Money Honey, Maria Bartiromo, about hydrogen in the pick-up turning out ice water for a driver's side water fountain. It was ludicrous, but interviewer after interviewer gushed just like a water fountain. And who had gone back and issued corrections, much less mea culpas?
A few podcasts had done so, but they weren't being offered into evidence. Not relevant, Judge Ramos might say. But the burden of proof against corporate media was being reached. Where would that jury deliberate?
As the first week of the trial wound down, it seemed that Friday might be less than a full day - something that was NOT part of Judge Ramos' plan, when he said the trial day would end at 2:30 because there'd be no real lunch break and they would sit five days a week.
(Already another trial in a smaller courtroom higher up in 40 Foley, begun the same day as Milton's, was taking a break from a Thursday charging conference to Monday for the closing arguments. It was wire fraud, too, but much simpler. No Money Honey for email fraud and fake bank accounts.)
The prosecutors put in a letter about why they might break early, a death in a family and the need to keep the witness batting order sequential. But it wasn't clear if Judge Ramos would accept it. The prosecutors could just come up with more questions for their witness Dale Prows. Some of it already seemed repetitive.
