Man Deemed Career Criminal Gets 12 Years For Robbing Pawn Shop Reduction Under Rivers

SDNY COURTHOUSE, June 30 – Yaurel Centeno was up for sentencing after pleading guilty to the armed robbery of a pawn shop in Queens, New York, with a previous record qualifying for Career Criminal status. 

  On June 30, 2022 U.S. District Court for the Southern District of New York Judge Jesse M. Furman held the sentencing. Inner City Press went and covered it.  

 Due to criminal history, the guideline sentence was between 262 and 327 months. Judge Furman inquired into the applicability of US v. Rivers, 50 F.3d 1126, 1130-31 (2d Cir. 1995); he said the guideline was significantly too harsh. 

 In the gallery, along with Inner City Press, were family members of Yaurel Centeno. They leaned forward to hear. Defense counsel asked for seven years, linking it to four years of college, three years of law school.

  Judge Furman said while 262 months was too much, seven years would be too little, given the crime and history.

He sentenced Centeno to 144 month - 12 years - citing the defendant's heartfelt letter and more dispositive statement in the proceeding. He said he hoped not to see him after the 12 years, meaning on a VOSR.
