Bevelyn Williams Gets 41 Months in Freedom of Access to Clinic Entrances Act Case

SDNY COURTHOUSE, July 24 – In late 2022 Bevelyn Beatty Williams and Edmee Chavannes were indicted for conspiracy to violate the Freedom of Access to Clinic Entrances Act. 

 On February 2, 2024 their final pre-trial conference was held before U.S. District Court for the Southern District of New York Judge Jennifer L. Rochan. Inner City Press was there, the only media in the courtroom. Thread

On February 12, Inner City Press covered the selection, past 6 pm, of a jury of seven men and five women (of the four alternates, three are men). At least one donor to Planned Parenthood, it is noted, made it only the jury.

On February 14, after a snow day and a juror's late arrival, the prosecutors put on the stand Lauren Betters and a Mr. Liman about the June 19-20, 2020 protest at Bleecker and Mott Streets, and the non-engagement policy as a business record.

On February 16, a witness described protests in Fort Myers and Naples, Florida. He said he thought protesters had guns.

On February 22, Williams was found guilty - but Chavannes was found not guilty.

Judge: Will any victims speak?

Assistant US Attorney: Planned Parenthood is not here yet... On the substance, we note she crushed a victim's hand with the door.

Defense: We dispute it was a violent assault. She was boisterous- it was a protest by disparate groups  Judge: It was an assault with a dangerous weapon - here, the door. She pushed it while singing "We Shall Not Be Moved." So the Guideline is 37 to 46 months in prison. 

Defense: We ask for a downward departure. Ms. Williams is a stay at home mother in Tennessee.

AUSA: We oppose any downward departure. These are just ordinary family responsibilities. Judge: I will not be departing downward on this.  AUSA: There was a 9 day trial. She blockaded and invaded Planned Parenthood in Fort Myers, Florida, the guard thought they might be armed so he ordered a lock down. At the Atlanta Women's Center, another lockdown. And Nashville in 2022...

 AUSA: She bragged on social media. She posed as a patient in Nashville. She invaded 2 facilities in Brooklyn. This is her 8th conviction. She has served only 30 days. 1000s were watching, many are watching the outcome of this case. Others need to be deterred. 

AUSA: We request a guidelines sentence.

Judge: Do any victims wish to speak? AUSA: They are not here.

 Defense: She has a 2 year old daughter. It has changed her. She cried after the verdict. She grew up in poverty. She has sustained convictions.  Defense: She has turned down media, CNN and FOX. She could have criticized the jurors. She waited until today, to explain herself to the Court. [Drum roll]

 Defense: We ask for no incarceration. Judge: What about deterrence?

Defense: She won't do it again. General deterrence is unproven.

Bevelyn Williams: Can I use the bathroom? Judge: Of course. In the jury room [Williams rushes]  Bevelyn Williams: I had my first abortion when I was 15 [sobs] It took a toll. It was one thing to have sex outside of marriage, with a knucklehead boy like me. There were picketers at the clinic 

Bevelyn Williams: It was cut out of me... Two abortions later, and in jail in Rikers Island for scamming like my mother, I met a lady in jail. She ministered to me. I gave my life my Christ. 

Bevelyn Williams: I am loud, yeah. But I am saved. I wanted to preach the Gospel. I know what it's like, to lay with a random guy and get stuck with a baby. God knows what I did. He's washed me. 

Bevelyn Williams: I'm sorry for that lady's hand. I fear God more than this courthouse. Someone drops a wallet, the old me woulsa kept it. Not now... I feel I'd get less if I stayed a criminal. I feel like I'm "a Negro out of line, stay in your lane" 

Judge: I am going to take a break to think about this

 All rise! Judge: Ms. Williams says she wants to be a good person. But this is serious misconduct. She obstructed, she pulled a barricade away. She yelled in people's faces, during COVID. She pressed the door closed on a victim's hand to stop legal medical service 

Judge: She live-streamed her flouting of the law. A significant sentence is needed. Places of worship are also protected under this Act. In DC there was a 57 month sentence. I've considered the JSIN data. Other people are following this sentencing  Judge: The appropriate sentence here is 41 months in prison.

Ex FBI McGonigal Pled Now Shestakov Trial Delayed to Feb 2025 Amid Discovery Disputes

SDNY COURTHOUSE, July 23 -  In the U.S. District Court for the Southern District of New York, an arraignment was held by Magistrate Judge Sarah L. Cave former FBI agent Charles McGonigal, for helping Russian oligarch Deripaska in violation of US sanctions, and money laundering.

 McGonigal, who'd hired former US Attorney for the Eastern District of NY Seth duCharme, pled not guilty and was given a $500,000 personal recognisance bond bail deal. Thread below. He has also been indicted in the District for the District of Colombia.

McGonigal: I agreed to collect open source information about a business competitor of Oleg Deripaska, to try to put him on the US sanctions list. I knew that it was wrong. I want to thank you for treating me fairly.

On November 30 McGonigal's counsel Seth DuCharme submitted partially redacted letters and a sentencing memo asking for a "non-custodial sentence" - that is, no jail time. Former FBI Thomas S. Shaughnessy recounts McGonigal "saving" an FBI field agent named Mike, no last name, "rough as a cob with a true potty mouth."

He also recounts McGonigal giving "Angry Kevin" the "Bradley Manning / Julian Assange case ('Wikileaks') and that case made Kevin's reputation." Letter on Patreon here.

On December 7, the US Attorney's Office wrote in and request a sentence of 60 months, and a $200,000 fine.

Some of the letters are touching. Sentencing was set for December 14 at 1:30 pm.

Later the surrender date was moved to March 18 - and on March 12, McGonigal's counsel wrote in to request another 11 week extension, letter on Patreon here.

On March 18, Judge Rearden extended McGonigal's surrender date to June 3, 2024.

 McGonigal's co-defendant Sergey Shestakov has a hearing - Judge wants trial to remain June or August, says there is a public interest in moving forward. Judge: So, August 6 is trial. And I'll name an additional CJA counsel to assist

But on July 23, amid acrimonious discovery disputes, that trial was pushed all the way back to February 10, 2025. Inner City Press was there, from the thread:

Defense: They have McGonigal's laptop, we want it. They oppose our subpoena to the NSA. They want to put in statements by Mr. Fokin - so have they wiretapped him on other occasions?

AUSA: Discovery is not a fixed in time thing... Defense: This is a mealy mouthed answer. NSA and CIA have information material to our defense.

Judge: OK, we are adjourning the trial. CIPA conference(s) August 7, 3 to 5 pm.

And then the trial was pushed all the way back to February 10, 2025

In Eaze and Wirecard Trial of Weigand Hargreaves Cited OneCoin Now Time Served

SDNY COURTHOUSE, July 23 – The trial of US v. Weigand and Akhavan began before Judge Jed S. Rakoff in the U.S. District Court for the Southern District of New York on March 1. Inner City Press, which has been covering the case including its Wirecard aspects, live tweeted Day 1, here and below. Now on March 9 it has connected back up to the OneCoin crypto fraud - and the US has explained Hargreaves' phones, in an 8-page filing.

Jump cut to June 15, 2022 when Hargreaves was to be sentenced. But that day, the US wrote it and asked for another six month adjournment, to December 14, 2022.

Another major jump, to October 31, 2023 - when Hargreaves' sentencing was pushed into 2024: "The sentencing control date in this matter is hereby ADJOURNED to March 6, 2024 at 3pm. (Signed by Judge Katherine Polk Failla on 10/31/23)." The government's request was "in light of the defendant's ongoing cooperation."

On March 5, 2024 the US Attorney's Office wrote to Judge Failla, "The defendant's cooperation is likely complete... adjourn the sentencing control date by approximately 90 days. The Government may also submit a related case letter []prior to sentencing."

Judge Failla endorsed it, adjourning Hargreaves' sentencing to July 10 at 3 pm.

Who has Hargreaves been cooperating against?

On May 22, Hargreaves case was reassigned from Judge Failla to Judge Rakoff, who presided over Weigand's trial: "NOTICE OF CASE REASSIGNMENT as to Oliver Hargreaves, to Judge Jed S. Rakoff. Judge Katherine Polk Failla no longer assigned to the case."

On Mau 29, Judge Rakoff (re) set a sentencing date: "NOTICE OF HEARING as to Oliver Hargreaves: A sentencing will occur on July 23 at 4:30 pm in courtroom 14B  before Judge Jed S. Rakoff."

On July 23, it was moved up to 3:30 pm, then delayed by an Afghanistan criminal trial Inner City Press is also covering. Then, very quickly, time served - thread:

Judge Rakoff: I intend to give a time served sentence. Unless you want to speak-

CJA counsel : It's been six years of cooperation. He lives in Barcelona.

Judge: He can be supervised telephonically

AUSA: We have no problem with no supervision Judge: OK, no supervision

Hargreaves: Thanks

Judge Rakoff: You could appeal but then I'd have to order a competency hearing...

  Day Four began with news, tweeted by Inner City Press, that a juror had tested positive for COVID, and ended with cooperator Oliver Hargreaves on the stand.

  Day Five, things took off. The remaining 13 jurors all tested negative and when Hargreaves testified, first about fake website for golf equipment and facial cream, he soon turned to the meat: Wirecard and Jan Marsalek, live tweeted thread below. Hargreaves on cross examination admitted he and his boss Gary Murphy had dealt with OneCoin crypto-Ponzi money launderer Gilbert Armenta, whom Inner City Press has covered, including exclusive reporting on Armenta's ongoing businesses. Judge Rakoff: It's his opinion. Hargreaves: Yes. OneCoin was a crypto currency fraud.

Defense lawyer: Armenta had a bank in Georgia, right?

Hargreaves: Yes, I think so.

 AUSA: Was the fact that Eaze transactions were intended to be run through these Hot Robots accounts disclosed anywhere?

Hargreaves: No.
AUSA: In this Ali Baba chat, Ray says, So darling what will be submitted, right? Hargreaves: Yes. And Reuben says, it's fine

In the courtroom on the 26th floor, Oliver Hargreaves is sitting without a mask in a plexiglass box, glasses on, light suit, not much hair. He's saying that the transactions were fraudulently run through as for "facial care products."

  Earlier on March 8, a request to exclude information from the devices Hargreaves had when he was arrested and began cooperating has been filed, including "On Sunday, March 7, 2021, the government produced a subset of the iPad material that it represented to be the unique material from the iPad, which the defense continues to review. That same day, the government also produced additional 3500 material for Mr. Hargreaves that indicated the phone may have been  [REDACTIONS]

"It is now abundantly clear that those communications almost certainly do not provide a full record of the interactions between Mr. Hargreaves and others implicated in the scheme because the government did not take any steps to preserve Mr. Hargreaves’ communications at the time, nor did it disclose that failure to preserve until now." In Sue Mi Terry FARA Case DOJ Will Use FISA Info with Classified Litigation Predicted

SDNY COURTHOUSE, July 22 – Sue Mi Terry was on the US National Security Council. Now she has been indicted for violating the Foreign Agent Registration Act for South Korea, in exchange for $37,000 and luxury handbags, among other gifts. 

 Her handler worked at the South Korea Mission to the United Nations, which Inner City Press has also covered, along with the U.S. District Court for the Southern District of New York.  

Terry has been released on $500,000 bond co-signed by her husband, columnist Max Boot.

Wolf of Airbnb Pled Guilty now Gets 51 Months After Declines to Speak at Sentencing

SDNY COURTHOUSE, July 22 – The self proclaimed Wolf of Airbnb Konrad Bicher pled guilty on June 26, to a deal of 46 to 57 months and nearly $2 million in both forfeiture and restitution.
 
  The change of plea was before U.S. District Court for the Southern District of New York Magistrate Judge Sarah L. Cave.

On January 18, 2024, the US Attorney's Office wrote in and asked for a sentence of 51 months.

On July 22, Inner City Press was in the courtroom, thread:

Defense: This story took on a life of its own. Some landlords were complicit-

Judge: How is that mitigating?

Defense: The landlords did not have clean hands

Bicher declines to speak.

Judge: You bragged to the press about your exploits. My fear is that there is no real remorse here. I sentence you to 51 months

Brooklyn Festival for Saint from Nola Fills Streets with Trumpets & Capos Amid DE News

BROOKLYN NY, July 21 –    A block from the Brooklyn Queens Expressway a four story tall, four ton monument was carried through the streets on Sunday, accompanied by trumpet players covering Frank Sinatra's New York, New York. 

 It was the annual Festival of the Giglio, which commemorates Saint Paolino of Nola substituting himself in slavery for a widow's only son in 409 A.D. 

The feast, held in front of Our Lady of Mount Carmel church in Williamsburg, was not held in 2020 due to COVID. But it's back, and on Sunday the sausages were frying, the Manhattan Special coffee soda was cold and the head men - called Capos - came down the church steps dramatically when their names were called.  

This was mid afternoon on July 21, just as from Delaware Joe Biden announced online that he was withdrawing from the Presidential election. Inner City Press, marching with the capos under the giglio, put up a video, here
