Meth Dealer With Yale Degree Mark Mattek Pled Guilty in SDNY Then Time Served, Wisconsin

SDNY COURTHOUSE, August 29 – A defendant with an Yale masters degree pled guilty to conspiracy to sell crystal methamphetamine and liquid GHB on March 29, 2019 in the U.S. District Court for the Southern District of New York courtroom of Judge Victor Marrero.

 Inner City Press was the only media present and the plea colloquy was the normal until, first, the health questions were hit. Philip Weinstein the lawyer for defendant - who we left unnamed until checking, and now publish, Mark Mattek - turned and glared at Inner City Press, then asked to answer the question "off the record."

He said, "May I approach." Judge Marrero replied, quiet naturally, that then it would be on the record in front of the court reporter. Everything the lawyer said was audible, although we still withhold it from compassion. Weinstein returned to counsel's table and next up was reference to a cooperation agreement, did the defendant with his masters degree understand it. Yes.

There was a cursory allocution, the government saying the drugs and cash were found in Mattek's apartment which was on West 46th Street - and then a request that the transcript of the proceeding, which had been open, be sealed.

 This seemed strange; Inner City Press in an abundance of caution or responsibility withheld identifying information until, without electronics in the courthouse, it was able to in-person ask about the rules. If it's open, it's open.

  And so now, in August 2021, Inner City Press revisited the case. It was transferred to the Eastern District of Wisconsin; quietly, Mattek was given a time served sentence with a number of entries in the dockets listed as sealed.

Another Case of UN Racism As UNDT Case on Collusion with Ethiopia Tweeted By Inner City Press

UN GATE, August 29 – How corrupt and unaccountable is today's United Nations?

 Well, in November 2020 Inner City Press went to attend and report on a UN Dispute Tribunal proceeding about a case of sexual harassment in the UN, a proceeding which was announced as open to the public, as US court cases are. 

 But when Inner City Press signed in and gave its name, it was excluded. Later, when it obtained and published evidence presented in the case, a UN Dispute Tribunal judge ordered it to destroy the evidence or be banned from all future proceedings. 

 This while UN Secretary General Antonio Guterres falsely claims to have zero tolerance for sexual harassment and abuse, while himself banning Inner City Press from UN briefings now for 1251 days.

  On August 24, Inner City Press - without any recording of which it was baselessly accused after UN sex abuse evidence was leaked to it by UN staff disgusted with Guterres' cover ups - live tweeted another UNDT proceeding from Nairobi, about collusion with the Ethiopian government, here and below.

Now we note this typical case of racism in the UN of Guterres: "The Applicant has served as a Conflict Resolution Officer at the P-4 level with UNOMS since September 2004. 3. The Applicant also acts as the President of the United Nations People of African Descent (“UNPAD”), an ad hoc special interest group created in 2016 to raise awareness about issues of racism in the United Nations.

4. In October 2019, in her capacity as President of UNPAD, the Applicant wrote to senior officials of the United Nations advocating on behalf of a staff member. 5. By email dated 24 October 2019, the Ombudsman informed the Applicant that she should step down immediately from any leadership role and active participation with UNPAD. The Ombudsman stated that “[her] role as president of UNPAD undermines the neutrality and independence of the office” whose role is not to advocate on behalf of any one individual employee. The Ombudsman wrote that there was a conflict of interest when the Applicant advocated for a staff member who was referred to UNOMS and there was a potential conflict of interest in future cases.

6. On 4 November 2019, the Ombudsman received an email from the Director of the Division of Healthcare-Management Occupational Safety and Health (“DHMOSH”) informing her that the Applicant, as a Conflict Resolution Officer in  Case No. UNDT/NY/2021/035 Order No. 78 (NY/2021) Page 3 of 13 UNOMS, was requesting a meeting concerning a staff member she had previously advocated for as President of UNPAD. The next day, the Ombudsman responded to the Director of DHMOSH that the Applicant was not acting on UNOMS’s behalf and had no authority or standing to discuss such private sensitive issues.

7. On 1 April 2020, the Applicant began a temporary assignment with the United Nations Economic Commission for Africa. 8. In early March 2021, the Ombudsman was notified that the Applicant would be returning to UNOMS, effective 1 April 2021. 9. On 8 March 2021, the Ombudsman reached out to the Ethics Office to request an opinion as to whether the Applicant’s service as President of UNPAD represents a conflict of interest with her duties as a Conflict Resolution Officer in UNOMS. 10. On 12 March 2021, the Director of the Ethics Office responded that it constituted a conflict of interest, stating that “the official duty of a UNOMS staff member to remain independent and neutral would conflict with leading and representing UNPAD and its staff special interest”. The Director of the Ethics Office continued that “it is for the Head of Entity to assess whether a particular act or omission raises a potential conflict of interest” and that staff members are obliged “to follow instructions on how to resolve the situation, including to avoid and remove the conflict or the circumstances that make it a possible conflict”.

11. On 15 April 2021, the Deputy to the Ombudsman wrote an email to the Applicant to discuss her work plan for the 2021-22 cycle. In the email, the Deputy to the Ombudsman wrote that the Applicant would directly report to him and that she would take over several focal point functions. 12. On 23 April 2021, the Ombudsman informed the Applicant that the Deputy had been placed on sick leave for the remainder of his tenure with UNOMS. Noting that the Deputy had started discussions with the Applicant on her work plan, the Ombudsman asked the Applicant to clarify whether she was still serving as President  of UNPAD in order to make an informed decision on her workplan.

The Ombudsman reminded the Applicant that it had been determined that there is a conflict of interest between the work of a Conflict Resolution Officer in UNOMS and her position as President of UNPAD. 13. On 28 April 2021, the Ombudsman wrote an email to the Applicant. She stated that she understood that the Applicant was still the President of UNPAD and would not step down and asked the Applicant to clarify in writing. The Ombudsman warned that in the absence of any clarification in writing, she would proceed to take the administrative actions that she deemed appropriate. 14. On 30 April 2021, the Ombudsman wrote to the Applicant that until her status with UNPAD was clarified, the Ombudsman could not complete any discussions around work assignments and stated that she had not been given any assigned work.

15. On 12 May 2021, the Ombudsman issued a written reprimand to the Applicant for the continuation of the conflict of interest. 16. On 16 June 2021, the Applicant was notified that her fixed-term appointment would not be renewed beyond its expiration on 31 August 2021. The Applicant requested the reasons for the non-renewal decision and received the following response: [The Ombudsman] advised that her decision not to renew your appointment is based on the ongoing conflict of interest with your role as President of UNPAD, which is in conflict with your position as a conflict resolution officer requiring neutrality as per the mandate of the Office of the Ombudsman.

[The Ombudsman] further advised that she has repeatedly communicated the conflict of interest with you but that you have taken no action in this regard. Due to this conflict of interest, [the Ombudsman] indicated that she has not been able to assign you any work related to conflict resolution, the role for which you were recruited.

[The Ombudsman] stated that this has been the situation since your return from a temporary assignment 1 April 2020. Case No. UNDT/NY/2021/035 Order No. 78 (NY/2021) Page 5 of 13 17. On 16 August 2021, the Applicant received the memorandum titled “Separation upon expiration of appointment”

  NOTE: Ms. Kamara-Joyner is a “Conflict Resolution Officer” in the Ombudsman's office, which is patently incapable of mediating or resolving a conflict in the Ombudsman's office. Close observers note that counsel for the Secretary-General is arguing that if you are black, and you take an active role in a UN organization to raise awareness of racism – you cannot get involved in drawing attention to a blatant case of racism because that would compromise your independence given your role in the Ombudsman's office.  In Big Tony's UN it's perfectly OK to have a group that raises awareness about issues of racism in the UN – provided that they don't actually raise any specific examples of racism in the UN…. which rather begs the question of what purpose it actually serves. We'll have more on all this.

From August 24: now a case in UN kangaroo court in Nairobi. UNDP Country Director Samuel Bwalya is charged with conspiring with minister of Ethiopia goverment.

Bwalya's "lawyer" Edwin had his cross examination cut off by UNDP representative Esther Shamash. Then he was cut off altogether.

 Bwalya's "lawyer" is back. UN "judge" Rachel Sikwese immediately rules to exclude evidence, and questioning, in this case about UN colluding with Ethiopia government / Minister.  Now on next question, UNDP's Shamash objects. And the document is out.

The witness, who is being protected by UNDP's rep and it seems the judge, seems to be named Helina Tadisse. But that camera is not on. Unclear how any finder of fact would make a judgment about credibility.

 Balwya's lawyer: So the Minister was very happy with the UN's work? Witness: He was satisfied, yes.  Balwya's lawyer: In processing the procurement contract- Witness: I don't recall. I don't remember. Balwya's lawyer: You don't remember. UNDP: Asked and answered!

 Balwya's lawyer: If we can go into the report, I will conclude. Judge: We are waiting. UNDP "counsel" - These matters are not before the tribunal. [Inner City Press: Like UN claims its giving of Uighur names to China is not in case of  Emma Reilly

 Bwalya's lawyer: Did you provide that to the ATA? Witness: I may have, I don't remember. Bwalya's lawyer: That doesn't help me much. UNDP's "counsel" - I'm being blindsided. [Reference to a bundle that is apparently not public.]

Now Judge lets UNDP "lawyer," who reps UNSG  @AntonioGuterres , run the table. Guterres has had Inner City Press banned from UN briefing for 1249 days - and  @UN_Spokesperson  doesn't answer it questions, or Quinn Emanuel letter, video here.

  On evidenc destruction-gate, banned Inner City Press' timely appeal has been "deferred" from Guterres' kangaroo Appeals Tribunal, until October 2022 at least, while his Melissa Fleming refuses to answer even a major US law firm - this is impunity, see below.

Now this UN report complains, "15. During the reporting period, the holding of public hearings remotely raised its own set of difficulties. The registries experienced difficulties in controlling the access to the virtual public gallery, which is not problematic in the physical courtroom. It is also more difficult to control whether the public abide by the Tribunal’s instructions, in particular the prohibition of recording the hearing." No, UN staff disgusted with Guterres' cover ups leak.

The deferral: "The June 2021 Synopsis file of UNAT judgments was published.  They heard only 32 appeals, and the last appeal number heard in the session was 1468. So Inner City Press'  appeal number 1502 won't be considered at a minimum until the late October 2021 session.    The current estimated time from submitting an appeal to being considered is almost one year.   Speedy justice?  The Guterres Administration knows and exploits this.  A typical UNDT case takes at least 18 months and then the appeals process takes at least a year.   Hence why the Administration appeal every successful UNDT judgement by a staff member, it costs them nothing, while it costs the staff member plenty, as well as delaying any justice they may end up getting, which is usually little. Guterres' UN is corrupt - and cannot be allowed to continue banning the Press which reported on it.

  In the case Inner City Press was ordered to destroy evidence of who-done-it, even the UNDT has found Padula guilty - but has insisted that he be anonymized, that is, covered up for. The shameful order is here, and recites for example that the person - Padula - covered up for

.“grabbed [AA’s] face, held her closely, leaned forward and attempted to kiss her”; b. “when [AA] resisted [the Applicant] kissing her, [he] forced [AA’s] head down and kissed her on the forehead”;  c. “grabbed [BB’s] face, held her closely, leaned forward and attempted to kiss her”; d. “tried to move physically close to [AA] and [BB] while dancing, despite their attempts to keep [him] at a distance”; e. “attempted to grab [CC’s] face; when she blocked her face with her hands, [the Applicant] grabbed her hands and tried to pull them apart; when she resisted, [he] fell on her forcefully”; and f. “took and pulled [CC’s] hands to try to get her to dance, despite her resistance”.

  But in Guterres' UN they do not want the public to know who did this - and the Press which exclusively published and name and evidence is banned and its written questions not answered. On the morning of February 4, 12 hours before publishing this when no answer was received from Guterres, Dujarric, Fleming, Amina J. Mohammed et al., Inner City Press in writing asked this: "what are SG Guterres comments and more importantly action on the UN Dispute Tribunal on Feb 3 confirming sexual charges against Padula - while having told Inner City Press to destroy all evidence or remain bannned, and maintaining Padula's name sealed, confirming the cover-up culture under Guterres?"

 The UN claims it has to protect the identity of Padula (and will NOT report him to NYPD for any criminal offense) because they have to protect the identity of the VICTIMS - it's like Guterres' rationale for covering up genocide and mass killing, for example in Cameroon.

  Inner City Press is even banned from submitting questions by WebEx, on which the International Monetary Fund for example answers its questions, as it did on February 4 about the Burma coupl. The only difference is Guterres and his corruption.

   On December 21 Inner City Press filed a formal appeal with the UN Appeals Tribunal, full filing here on DocumentCloud.

 And now in late January Guterres' long time Portuguese lawyer Miguel de Serpa Soares has responded, that Guterers is not waiving immunity, impunity response on Document Cloud here. Impunity.

 On the morning of January 26 Inner City Press emailed Guterres and his spokespeople this question: " Given that the UNDT order destruction of evidence concerning sexual harassment inside the UN, why is SG Guterres not waiving immunity?" No answer.

Nurture Baby Food Is Sued For Heavy Metals But Tells SDNY the Metals Are Organic

SDNY COURTHOUSE, August 28 – Many cases were filed against Nurture, Inc., a self-described source of organic baby food, for having heavy metals in its products.       

    On August 27 U.S. District Court for the Southern District of New York Judge Mary Kay Vyskocil held a proceeding. Inner City Press covered it. 

  Nurture wanted a change in the caption from "In Re Nuture Heavy Metals Litigation" to just "In Re Nurture Litigation," with a description of the heavy metals lower down.

  Judge Vyskocil asked about a reference to "non-economic damages" and proposed a change after the response contrasted harm at the check-out line to physical harm.

 The lead case, for now, is Spencer v. Nurture, Inc., 21-cv-6861 (Vyskocil)

After Inner City Press Scoop on UNTSO Sex in UN Van Staff Say Stage 8 Discipline, Guterres Cover Up

UN GATE, August 28 – The United Nations claims to have a zero tolerance for sexual exploitation by its staff and peacekeepers, but routinely covers up their abuses including the rape of children, withholding basic information which was provided to the Press under Ban Ki-moon but not now under Antonio Guterres. 

 Today Inner City Press expands its exclusive reporting into UNTSO's scandal of public sex in the UN van, with information from UN whistleblowers in Jerusalem and New York: "the men in the UNTSO car have been charged with transporting a passenger who was not authorized and also for not co-operating with the investigation."

Inner City Press asked, "Thanks - I'd heard they were restored to full pay."

Answer: "Still suspended, but have been getting salary for a year.  Now they have been accused of conduct unbecoming."

  But seemingly no charge for the public sex - Guterres' emboldened goons have done that in DRC, Haiti and elsewhere. Just list whose in the car, and share / brag about it later?

  Now, alongside the cover-up by Antonio Guterres and his spokespeople Stephane Dujarric and Melissa Fleming, who refuse Inner City Press' written questions and ban it from entering to ask in-person, as state media and retirees are allowed to do (but don't ask about this), delay under UN due process rules for sex abusers but not journalists:

"The Assistant Secretary-General for Human Resources Management may seek  further information from any relevant source. Any new additional information  received by the Assistant Secretary-General must be provided to the staff member  for a further response. The staff member shall be given two weeks to respond to  such additional information. The staff member may request, in writing, additional  time to respond."

   Inner City Press, which Guterres has banned from the UN for 1070 days as it asks about these and his abuses, on June 23, 2020 received from outraged UN whistleblowers video of sexual exploitation, they said, in a white UN-marked vehicle, here.  Now Instagram, Facebook.

  Now on the morning of June 6, this exclusive: The three members from UNTSO who were involved in that disgraceful act within a U.N. vehicle in Tel Aviv 12 months ago remain part of the mission on full pay one year later.   The Head of Mission General Lund is investigation for fraud and misuse of entitlements by Norway and others.

  The Mission Senior advisor Judy Hylton is under investigation  for abuse of authority.  The smuggling of alcohol in a U.N. VIP vehicle across borders from Jordan, Syria and Lebanon.  She is also under investigation for exceeding the two years secondment in UNTSO.   She has been in UNTSO from UNHQ for five years.   

  A dysfunctional HQs. Open infighting between mission leadership members. Two of the five mission leadership now under serious OIOS investigation. No wonder the junior staff members feel self entitled and act without accountability. This is the UN of Guterres and his in-house enablers.

 Jump cut to June 3, 2021, when UN insider Pass Blue ran a story falsely crediting another for the June 24 publication of the video - and implying that it an unfair attack on the UN. What a scam.

  The article ignores that the UNDT held proceedings, and that UN Spokesman Stephane Dujarric said on camera that three staff were suspended without pay, then never updated when they were restored to pay. All of this could have been or was known to Pass Blue from simple Google searches. But either they have an agenda, or are incompetent, or both. Before this article, Inner City Press tweeted it, and submitted a comment, now blocked in "moderation."

  A full day later, Pass Blue put up one comment on the piece (only about Israel and Palestine) and disppeared the comment Inner City Press submitted; the piece's author, Maurizio Guerrero we report a day later with a heavy heart, previously wrote to Inner City Press, "definitely there are some that want you out of the UN, as a punishment." We'll have more on this. June 4 stand-up here.

 Those who feign to scrutinize the UN love this blue wash. But it is one of the reasons it's UNreformed.

  Inner City Press named to the UN the two men in the UN van: Michael Antoine and Ray Millan. The UN did not answer Inner City Press, but on July 2 Guterres' spokesman Stephane Dujarric said Antoine and Milan were no longer being paid.

 Since September 9, this has been a lie as to Antoine, but Dujarric did not answer Inner City Press questions on September 14, see below.

On September 28, despite Inner City Press' IP address being blocked from the UN's and UNDT's websites, we reported that Millan, too, has been restored to full pay: "the Tribunal is satisfied that the nature of the alleged conduct and its unfortunate publicity...  The application, therefore, is granted to the extent it seeks to suspend the “unpaid” aspect of administrative leave." UNDT decision we've put on DocumentCloud here.  And from Guterres and Dujarric, nothing. They are lying about UN sexploitation.

 And UN staff have complained to UN about another video, here, which they have raised to Guterres' compromised OIOS investigators without action, here. They say "I was very happy to see how Inner City Press first published a video about UN staff having a sexual act inside a UN vehicle in Israel. It is thanks to you they have started an investigation and some actions were taken against those shameless UN staff.

A video of 1st September 2020 in Damascus involving a senior UN official, Mr. John Marks, Chief of UNICEF Operations in Syria. John and female UN staff are having a sexual act with an open window in the Four Seasons Hotel in Damascus. A female staff member is UNHCR Public Information Officer Mysa Khalaf, ex-Al Jazeera journalist, joining UN three years ago. Here is the John Marks video in youtube https://youtu.be/sAOtsyuY4o0 .  This shameful video was taken by a local Syrians in the street next to the hotel. It was circulated inside Syria on Facebook and other social media. A lot of anger and negativity towards the UN because of this. Locals now hate the UN because of this video in social media. Person in the video says in Arabic that these people are shameless. The Four Seasons Hotel in Damascus is where UN staff is accommodated in Syria for many years now. A senior UN official like John Marks, cannot behave in this manner, showing disrespect to local traditions and culture in Syria. It is unacceptable. He is in Syria for humanitarian reason and not for having sex with open widow showing to Damascus.   Although this video was reported to UN New York, UNICEF HQ in NY and UNHCR HQ in Geneva. Senior Management in both UNICEF and UNHCR are all trying to cover it. Nothing was done to these two UN Staff so far. Their behaviour is shameful for the UN and does not match with code of International Civil Servants and UN Humanitarian workers. They both work for humanitarian agencies UNICEF and UNHCR and people in Syria are desperate with the conflict situation and living with humanitarian crises. These kind of acts in public undermine entire humanitarian work.   This is Guterres' UN.

UN Guterres Heads To No-Vax UNGA Week For Dictators He Supports, Bans Press, Memo

UN GATE, August 27, Exclusive –  Since August 3, Inner City Press has each week end asked UN Spokespeople Stephane Dujarric and Melissa Fleming about the UN's planned "honor system" UN General Assembly week, without vaccination required. Then it also asked, Where *is* Guterres? No answer.

Now late on August 27  Guterres issued a second internal memo which banned Inner City Press exclusively publishes here:

"From: United Nations Sent: Friday, August 27, 2021 4:33:10 PM To: Broadcast - UNHQ NY Secretariat Agencies, Funds and Programmes  Subject: CORRECTION: Message from the Secretary-General to all personnel at UNHQ regarding arrangements for September 2021 | Communication du Secrétaire général adressée à l’ensemble du personnel du Siège de l’ONU concernant les modalités de travail pour septembre   Dear New York-based Colleagues,                  I hope this message finds you and your loved ones well.     Further to my previous communications, I would like to update you on the provisional working arrangements at United Nations Headquarters in New York from September 2021.  As communicated in my letter of 3 June 2021, the United Nations Headquarters in New York, as of 6 July 2021, have been reopened fully for in-person business, and all UNHQ New York personnel are expected to be present and work from the duty station as of 1 September 2021.   Given the COVID-19 conditions in New York, we will maintain our current posture.  This means that, with the exception of the High-Level General Debate period, all UNHQ New York personnel are to continue to perform their functions on premises one or more days a week until further notice.    For the High-Level General Debate period — 20 to 27 September 2021 (inclusive) — all UNHQ New York personnel who are not required to be on site to support the proceedings are mandated to work remotely under alternate working arrangements (AWA).  For those who have been informed that they are required to be on site, specific information concerning the arrangements during this time will be communicated separately by the respective Heads of Departments and offices.  The COVID-19 situation continues to be constantly monitored and measured to ensure a safe work environment for our personnel and delegates, and will be reviewed and adapted as needed.   Guidance on the COVID-19 prevention measures announced in my broadcast message of 13 August 2021 (on mask-wearing, indoor dining, vaccination status reporting and mandatory vaccination) will be updated shortly.  I also encourage staff who have not already done so to get vaccinated through the local vaccination programmes and report it through EarthMed."

Earth to Antonio: flying in unvaccinated delegations of dictatorships the UN supports, like in Cameroon, is contrary to New York City law - but Guterres asserts impunity, as on his ongoing ban on Inner City Press, not even answering the polite letter from the Quinn Emanuel law firm.

Question:  My second question is the law firm ‑‑ what is it called? ‑‑ Quinn Emanuel wrote a letter to the UN asking about reinstatement of our colleague Matthew Lee into the UN press corps. Do you have any comment on that?      

Spokesman:  No. All I can tell you is that we've received the letter, and I'm not aware of any change to his status.     

Question:  You're not aware? I mean, aren't you part of the group that decides the fate of... or even the negotiations... The letter calls for renegotiation [Cross talk]      

Spokesman:  I decide the fate of no one. [Laughter]      Trust me, trust me, my authority is extremely limited, whether at home or at work.       What I can tell you and, joking aside, is that the letter has indeed been received, and I'm not aware of any... and there has been no change in Mr. Lee's status.     

Question:  Has the letter been answered? Do you plan to answer it?      

Spokesman:  It's been received. Whether or not it's been answered, I don't know yet.

The letter was received by the UN's Melissa Fleming, Maria Luiza Vioti and Tal Mekel and to each UNCA Executive Board member, to them citing UNCA's stated goals that it has a charter to supposedly uphold.

What's next? Since the letter, Inner City Press has published exclusive stories not only from the U.S. court systems but about the United Nations, including its agencies UNOPS, UNFPA, UNITAR and UNESCO. (Also credited in AP, Daily Mail, and Nigeria's Sahara Reporters, amid answers from the IMF.)

But none of its written questions have been answered by the UN Spokespeople, and it remains banned from entry to the UN's briefings. This must end.   

 Having asked for a colleagial discussion, and while still offering it, things must turn to the law. UNCA is a New York State non-profit which has not only not abided by its stated goals - it has tortiously interfered with a journalist's right to cover the United Nations.    The United Nations itself propounds Article 19 of the Universal Declaration of Human Rights, and has other legal duties that must be addressed by national courts, particularly in the UN's host country...
