SDNY COURTHOUSE, Sept 19 – The Joffrey Ballet School sued its former director Christopher D'Addario for in essence stealing their websites. But D'Addario did not show up, and a temporary restraining order against him, to be delivered to Network Solution and Go Daddy was issued.

 On September 18 U.S. District Court for the Southern District of New York Judge John G. Koeltl held a proceeding. Inner City Press covered it.  

Joffrey's lawyers emphasized that they had twice emailed the time of the hearing to D'Addario. Judge Koeltl said it was not ex parte then, and asked for argument. 

 It was argued - without opposition - that the loss of control of the websites put many jobs at risk; it was said the absent D'Addario has no case.

They quoted him replying, "Go right f*ck yourself.. happy the bankrupt the school in court." They said he is demanding $450,000.  

 The website is back up, but Joffrey's lawyers said their email is still being "played with."

Judge Koeltl added some handwritten notes to the TRO and said it would be posted on ECF.

The case is Center for American Dance, Inc. v. D'Addario, et al., 20-cv-7687 (Koeltl).

UN Propaganda Film Uses Forest Whitaker and Beyonce But Lies About Cholera and UN Rapes

UN GATE, Sept 19 – For a week the UN promoted a movie it had made to try to improve its image, using footage of George Floyd's brother and uninformed talk by Forest Whitaker and others - and a years' old video by Beyonce.

  When it launched on YouTube on September 19, the live comments were nearly entirely negative, including the the UN should be mass reported as scammers. But "GlobalGoalsUN" said, "Thanks for watching. We hope you like it." Today's UN is a scam.

While the United Nations speaks about press freedom and the upcoming UN General Assembly week under new President Zolkan Bozkir of Turkey, UN Secretary General Antonio Guterres has banned Inner City Press amid its questions about his finances and failures on Cameroon and in combatting or even just disclosing UN sexual abuse.

They've played an active part in uncovering UN corruption over the years. Where does... where do they stand regarding UN credentialing?      

UN Spokesman Dujarric:  Mr. Lee's status remains unchanged. Okay...       

 Question:  And does that mean that that's going to stay unchanged, meaning he's banned for the next... for this General Assembly?      

Spokesman Dujarric:  Well, I mean, there's no... we're not issuing any new credentials for this General Assembly, because there's really nothing... there are no physical... barely any physical events here. So, there's no... no temporary credentials are being given, anyway.     All right. Thank you very much. I will leave you in the capable hands of Mr. [Brenden] Varma....   

Brenden Varma, for PGA Bozkir, has refused to answer Inner City Press' questions about his backsliding on the one reform from the UN corruption scandal Inner City Press reported on, often exclusively, about PGAs Ashe and Kutesa; Bozkir has an empty "Ethics" page.

Varma then blocked Inner City Press on Twitter. This is today's UN - we'll have more on this issue. Inner City Press should be given the codes to access and ask questions at briefings immediately, like the state media and retirees Guterres and Melissa Fleming prefer and favor.

UN of Guterres Blocks From UN Website IP of Inner City Press After Spox Said Mr Lee Status Unchanged

UN GATE, Sept 20 – While the United Nations speaks about press freedom and the upcoming UN General Assembly week under new President Zolkan Bozkir of Turkey, UN Secretary General Antonio Guterres has banned Inner City Press amid its questions about his finances and failures on Cameroon and in combatting or even just disclosing UN sexual abuse.

  But then something changed. On September 19 and still as of this writing on September 20, the IP address Inner City Press uses was blocked from the UN's website. Video here. The UN sites worked when checked from another's laptop. So can the UN use public money to block Internet access to their "transparency" page by media which ask and criticize them about it? Watch this site.

For UNGA 2020 UN Declines Inner City Press Application for Access Leaving Blank the Why

UN GATE, Sept 21 – In the United Nations, on September 1 a list of speakers for the UN General Assembly week Sept 22-29 was released, photo here.

   From 2006 into 2018, Inner City Press closely covered each UNGA week from inside the UN, asking questions in the UN Press Briefing Room (which which France once threatened to use Secretary General Antonio Guterres' spokesman Stephane Dujarric to have it removed and its accreditation pulled).

  Inner City Press on September 5, 2020 submitted a formal application to cover this 2020 UNGA, including for access to the UN' online briefings, to ask questions about such crises as Cameroon, Yemen and China's expansionism. Receipt has been confirmed: photo here.

 Past 11 pm on September 20, hours before the UN's "The World We Want" event, the UN emailed Inner City Press that its application was "declined for the following reason" - BLANK. Photo here.

  This is how arrogant today's UN is with the public's money, and the contempt the UN has for due process, freedom of the press and other principles mouthed by Guterres and his gang. This is the World They Want - a world without criticism of them, without critics, where they can take bribes and cover up rapes with impunity.

  Guterres' chief propagandist Melissa Fleming, spending public money on a vanity podcast while refusing questions about what the UN actually, wants to limit physical entry into the UN building to so-called "resident correpondents." But even if that were legitimate (it is not), there is no reason to similarly limit access to online briefings. The IMF doesn't - Inner City Press is given the codes and asks questions and get answers.

 Thin skinned Guterres is abusing his position to block the Press from covering actual leaders. So what will member states and the UN's ultimate funders do? We will continue reporting. Watch this site.

 Most resident correspondents write nothing, or only propaganda. And who will decide on these "very limited non-resident" [sic] who will be allowed in? This is the beginning of a series. Thread here.

 The censored UNGA Week will be even more lame than usual, with most speeches - other than Trump's? - by video. Still in the first morning there are China and Russia, Qatar, Morocco and Iran. Cameroon's dictator Paul Biya, supported in his killing like many others by Guterres, is on Friday September 24.

 Yet only the same old retirees and state media will be allowed in, they say. Inner City Press will have more on this.

  Earlier on September 1 Inner City Press wrote to the Niger Mission, as incoming UN Security Council president, with questions about Cameroon, Somalia and UNsexploitation.

 The email address on the Niger Mission's UN web page did not work; it bounced back. A Direct Message on Twitter to @Niger_ONU was not answered.

This as Sani I. Mahamadou, Deputy Chief of Staff to Niger's president, bragged online of a "Very big day for Niger, who begins his month of presidency of the United Nations Security Council." They're off to a terrible start.

  Apparently Niger PR Abdou Abarry could only handle questions from pre-screened in-house correspondents, one of whose media has no story by her since 2017, another with no stories at all, at least one - actually, more -- a repeated #MeToo violator. Periscope here.

 Niger has not said a word about the slaughter in Cameroon, nor about the UN Peacekeeping sexploitation exposed by Inner City Press.

  The Program belatedly went up - with countries on which Niger ignored and censored questions: Myanmar, Somalia, where UNMAS sent local staff to be killed, and Colombia and South Sudan. There will be Francophonie on September 8. We have now written directly to the Mission's 404 spokesman - and will have more on this.

When Guterres' spokes- / hatchetman Stephane Dujarric holds his noon briefings this week while refusing all questions from Inner City Press despite an on camera promise. Again, what will member states and the UN's ultimate funders do? We'll report.

As Avenatti Gets Free Lawyer in Stormy Case Seeks To Seal Info As Inner City Press Opposes

SDNY COURTHOUSE, Aug 27 – When after three days of jury selection the trial of Michael Avenatti for allegedly extorting Nike began on January 29, Assistant US Attorney Robert Sobelman told the selected jurors that Avenatti was supposed to look out for the interests of his client, but he did not - he had a weapon, social media.  More on 1st day on Patreon here.

 On August 7 in the Stormy Daniels case, Avenatti had motions heard by U.S. District Court for the Southern District of New York Judge Jesse M. Furman. Inner City Press live tweeted it, here.

 Now on August 27, Inner City Press has filed a formal request that documents in the case not be sealed, full filing on Patreon here: "PLEASE TAKE NOTICE that Inner City Press and its undersigned reporter, in personal capacity, will move this Court before Honorable Jesse M. Furman, U.S. District Judge for the Southern District of New York, at a date and time directed by the Court, for entry of an order granting permission to the heard on/and the unsealing of the CJA Form 23 and associated documents including but not limited to affidavit in US v. Avenatti, 19-cr-374 (JMF) pursuant to Docket No. 86 in that case and the Court's inherent power, and such other and further relief as the Court deem just and proper. 

   As the Court is aware, the public and the press have a presumptive First Amendment and common law right of access to criminal proceedings and records. See Press Enterprise Co. v. Superior Court of California, 464 U.S. 501, 508 (1984). The presumption of openness can only be overcome if “specific, on the record findings are made demonstrating that closure is essential to preserve higher values and is narrowly tailored to serve that interest.” Press–Enterprise Co. v. Superior Court, 478 U.S. 1, 13-14 (1986) Non-parties such as Inner City Press and myself have standing to intervene in criminal proceedings to assert the public’s right of access. United States v. Aref, 533 F.3d 72, 81 (2d Cir. 2008).  

    Only this month in SDNY Magistrates Court the content of CJA Form 23s have been read out in the public record, including for the appointment of Federal Defenders. See, e.g., US v. Castro, et al., 20-mj-8994 (Freeman) & here.

 Those and other defendants whose CJA Form 23 and financial information have been disclosed including in Magistrates Court this month had the same arguments as made by Federal Defenders in their August 21, 2020 letter, that the information might be used against them. And yet the other defendants' information was disclosed.

   While Inner City Press' interests are journalistic, since Federal Defenders states that "there is no dispute over Mr. Avenatti's eligibility to be represented by Federal Defenders of New York, Inc., " for the record consider this letter as disputing that, including in light of the sums of money discussed and proved in the Nike trial before Judge Gardephe. If despite this defendant still claims there is no dispute about eligibility, consider this a request for a hearing (or additional, focused letter briefing) on that issue.     As stated in US v. Harris, 707 F.2d at 663 (which Federal Defenders asserts is distinguishable but we contend is not), facts should be determined through adversarial proceedings.    While beyond the scope of this letter, the Court could limit the use in this case by the prosecution of the unsealed information, without unnecessarily overriding the presumption of public access. Here, the sealing(s) and withholding of the CJA Form 23 and affidavit in their entirety go beyond those requested even in the CIA trial before Judge Crotty, US v. Schulte, 17 Cr. 548.

Griffith, 20-cr-15 (PKC), Docket No. 33 (LETTER by EMAIL as to Virgil Griffith addressed to Judge P. Kevin Castel from Matthew Russell Lee, Inner City Press, dated 5/18/2020, re: Press Access to documents in US v. Griffith, 20-cr-15), 40 (order to unseal) and 41 unsealed filings). See also Inner City Press' May 9, 2020, filing to this Court for openness in US v. Randall, 19-cr-131,  No. 343.  

The U.S. Supreme Court has recognized that reporting by the news media allows members of the public to monitor the criminal justice system without attending proceedings in person. Richmond Newspapers, Inc. v Virginia, 448 U.S. at 572-73  (1980). By attending and reporting on court proceedings, members of the press "function[] as surrogates for the public." Id. at 573.   Inner City Press has covered the case(s) against Mr. Avenatti for some time, see e.g., May 13, 2020, ESPN Louisville Sports Live, "On this episode of LSL, the guys speak with court reporter, Matthew Russell Lee about the lack of fallout from the evidence exposed about Nike in the Michael Avenatti trial," for example on radio here.

    Inner City Press and I are submitting this a day early in part because we are unsure if the US Attorney's Office will be pushing for openness to the public. In another pending case, US v. Edwards, 19-cr-64 (GHW), the Office had initially said that documents submitted by the defendant (described as the leaker of Paul Manafort's Suspicious Activity Reports) should be put in the public docket. Then, while Inner City Press is pursuing that, the US Attorney's Office has stopped pushing. So, just to preview, we may seek leave to sur-reply depending on what not only the defendants / Federal Defenders but also the US Attorney's Office have to say.   

Federal Defenders say that the US Attorney's Office lacks third-party standing to assert any right on behalf of the public to access the defendant's sworn financial statements, cited US v. Hickey, 185 F.3d 1064 (9th Cir. 1999). But here, Inner City Press is timely asserting the public and press' right of access.    The documents at issue should not be sealed and should be made available.
