Uber Eats Is Sued for Injury to Manhattan Woman But Says Its Mopeds Have No Insurance

SDNY COURTHOUSE, August 4 – Margaret Cushing was injured by an UberEats moped or e-bike which fell on her outside of 360 East 55th Street in Manhattan on June 13, 2021. She sued Uber.

 On August 4, 2022 U.S. District Court for the Southern District of New York  Judge Paul A. Engelmayer held a proceeding. Inner City Press covered it.  

The plaintiff's lawyer said all he had was the food delivery receipt, and the UberEats delivery person's first name: Tika.

Judge Engelmayer asked if was Indian food that was being delivered.

No, counsel replied, it was chicken fingers.

  Counsel for Uber said its delivery vehicles that are moped have no insurance.

Judge Engelmayer set a schedule for summary judgment motion(s), saying he could already see the theory of such a motion for Uber.

He set a next conference for January 16 at 10 am.

The case is Cushing v. Uber Technologies, Inc. et al., 22-cv-5542 (Engelmayer)
