The Rascals At 70 Disagreed on Touring So Suit in SDNY Now Attorneys Fees Bid Withdrawn

SDNY COURTHOUSE, July 6 – A dispute about the music of The Rascals has given rise to litigation.             

      On April 4, U.S. District Court for the Southern District of New York Judge John G. Koeltl held a proceeding. Inner City Press covered it. 

 The Rascals are now 70 years old. Two want to go on tour, a third might pending his health, and four (Brigati) does not wish to participate.

  Danelli has not drummed in public since 2013. He says the name cannot be used unless three of the four agree.

Judge Koeltl inquired into the status of the case, and told the parties that the currently assigned Magistrate Judge will be retiring soon and another Magistrate Judge would be assigned.

On July 6, Judge Koeltl held another conference, and Inner City Press again covered it. This time, Judge Koeltl ordered that the request for attorney's fees against Danelli is withdrawn without prejudice; neither side will appeal.

The case is Beata Music LLC v. Dino Danelli et al., 18-cv-6354 (Koeltl / Freeman)
