Chewy Sues IBM Calling It A Patent Troll Citing Suits Against Expedia & Zillow in SDNY

SDNY COURTHOUSE, Oct 8 – Chewy has sued International Business Machines Corporation, calling IBM a patent troll and seeking a judgment declarying that Chewy does not infringe the patents IBM threatened it about.        

On October 8 U.S. District Court for the Southern District of New York Judge Jed S. Rakoff held held a lengthy claim construction hearing. Inner City Press covered it.

   Chewy noted that IBM on patents has sued Twitter (2013), Priceline (2015), Groupon (2016), Expedia (2017), Zillow (2019) and Airbnb (2020), and quotes that they "basically surrendered and agreed to pay IBM loads of money without any actual trial that tests the patents at hand."  

 Elsewhere, the complaint notes IBM threats against Amazon as well, though not a lawsuit.

 It says, "Chewy is under a reasonable apprehension that it will be sued by IBM for the alleged infringement of the Asserted Patents." Judge Rakoff heard them from the start, scheduled for 2:15 pm to 6 pm.

The case is Chewy, Inc. v. International Business Machines Corporation, 21-cv-1319 (Rakoff)
